In Burlington Loan Management v HMRC [2022] UKFTT 290 (TC) the First-tier Tribunal (FTT) decided that an Irish taxpayer was entitled to the exemption from UK withholding tax under the UK–Ireland double taxation treaty (DTT) because no party involved in the sale of a debt had the main purpose of taking advantage of the treaty exemption.
