In the recent Supreme Court decision in Bookfinders Ltd v The Revenue Commissioners1 the court revisited the issue of statutory interpretation of tax statutes and in particular the principles set out in the majority judgment of O’Donnell J in O’Flynn Construction v The Revenue Commissioners.2 The court also clarified the question of whether s5 of the Interpretation Act 2005 applies to tax statutes.
